Lease terms:

The initial term of the lease is for a period of ten (10) years, which commenced in October 2001. The initial yearly rent was $5,000 monthly, with 3% increases (over the previous year) starting the second year. There is an additional 3% rent on annual gross sales exceeding $1,500,000. The Lessee also pays a proportionate amount of CAM (common area maintenance) charges, in addition to proportionate taxes and insurance costs (trip net). There are two five year renewal options. It is noted that the landlord has never enforced the annual percentage increase.
